SACRAMENTO, Calif. –
New legislation recently signed into law will permit licensed hunters to take or possess invasive mute swans in California, effective January 1, 2026.
The California Department of Fish & Wildlife has stated that this new law is designed to tackle the growing concerns regarding the spread of these non-native birds throughout the state.
Mute swans, now classified as invasive nongame birds, can be taken at any time by individuals holding a valid California hunting license. This classification also includes species like the English sparrow and the European starling.
Additionally, landowners and lessees are allowed to take or possess mute swans without requiring a hunting license or a depredation permit.
First identified in the Suisun and Napa marshes in 2007, mute swans have since expanded their range, with a current population estimate of around 6,900 birds. They are recognized as a restricted and harmful species, making it illegal to import, transport, or possess them according to California regulations.
Mute swans are not protected under the federal Migratory Bird Treaty Act, as they were introduced from Europe in the mid-1800s and are known for being highly invasive. These birds are territorial and aggressive, often taking over habitats that are crucial for native species and breeding ducks.
Assemblymember Jeff Gonzalez, R-Indio, introduced the legislation, known as AB 764. California Governor Gavin Newsom signed it into law on October 6, with support from the California Waterfowl Association. This new law aims to provide additional resources for managing the mute swan population.
The public is encouraged to report any instances of taking or possessing mute swans to the California Department of Fish and Wildlife’s Invasive Species Program.
